• Brad Rye, owner of Deacon HVAC, LLC. which formed in July of 2023 in Davie County and acquired All Phase Heating and Air, has applied to rezone 3 acres of gulley and place a 1 acre building and parking lot as close to adjoining residential owners as the site allows. Mr Rye’s proposal is to build a 100×100 warehouse /office facility and necessary service truck parking, dumpster, and salvage metal storage. The proposed site is not visible to 801 and other commercial property but rather is situated close the property lines in the back yards of 110 and 108 Sowers Lane residential properties. This site plan produces a number of concerns regarding appearance, noise, and water runoff onto residential neighbors. A detailed presentation of concerns was presented to the Davie Planning board on 1/23. Several associates of Mr. Rye, all of whom have vested interest in the project or have recently completed other real estate transactions with Mr. Rye, spoke in favor. All owners of adjacent properties that attended voiced their opposition to the proposal. The planning board Deferred the decision to allow Mr. Rye to attempt the address the concerns raised. Once the planning board makes a motion to approve or deny, the Davie commissioners will make the final decision. There is no ETA on that meeting at this point. Excessive watershed onto adjacent properties, location of the site in relation to property line(extreme edge bordering adjacent properties), and lack of visual buffer for residential neighbors were the primary concerns raised. Jody Everett spoke on behalf of the opposition and presented the concerns below.
